Complaining, in the right order
Order matters. Regulators bounce complaints that skipped the operator's own process, so going straight to GRA usually costs you two weeks. Run the internal mechanism first, get it in writing, then escalate with that paper trail attached.
The ladder
- Operator internal dispute resolution. Reg. 103 requires licensees to run a mechanism approved by the Authority. Submit in writing, not by phone, and keep the reference
- Give it a reasonable period and note the date. Reg. 104(a) provides that a licensee failing to pay winnings within 14 days is liable to a 5% penalty payable to the Authority
- GRA player redress. Attach your operator reference, dates, amounts and the operator's response or the absence of one
- For a missing M-Pesa credit rather than a dispute about entitlement, call Safaricom on 100 and request a transaction trace
- Small Claims Court for claims under one million shillings, if the money is clearly owed and the operator will not pay
- For gambling harm rather than a payment dispute, the NACADA helpline is 1192
What to put in the complaint
- Your account identifier and registered phone number.
- The exact amount, in shillings, and the date and time of the transaction.
- The M-Pesa confirmation code if one exists, or the fact that none was received.
- Screenshots of the withdrawal confirmation and of your balance before and after.
- A short factual chronology with timestamps. No adjectives.
- What you want: payment of a specific amount, or a written explanation of the deduction.

Note the second row's right-hand column. If you are playing offshore, none of this ladder exists for you. That is not a reason to avoid the offshore route, but it is the thing to weigh before you take it.
Can I complain to GRA about an offshore casino
No. GRA's jurisdiction runs to its licensees only. Your recourse offshore is the operator's own channel.
Do I get the 5% penalty if they pay late
No. Reg. 104(a) makes the penalty payable to the Authority, not to you. It is a compliance sanction, not compensation, and it is worth citing precisely because operators know that.
How long should I wait before escalating
Give the internal mechanism a documented, reasonable period. The 14-day marker in reg. 104(a) is a useful reference point when the dispute is about unpaid winnings specifically.
